Please carefully read the terms and conditions. By participating in Core Value Pilates, LLC you, the undersigned participant agree to be legally bound by these Terms and Condition. If you disagree with any of the following Terms and Conditions, you may not participate in Core Value Pilates, LLC.
Participation
Participant hereby acknowledges that his/her participation in the services provided by Core Value Pilates, LLC has been approved by a health care provider.
Participant agrees to inform Core Value Pilates, LLC prior to any lesson of any physical, mental or medical conditions and/or changes of any such conditions from a previous lesson.
Participant agrees to arrive on time for his/her appointment. Participant acknowledges that failure to arrive on time for his/her appointment may result in a cancellation of the appointment and will be charged for the full price of the appointment.
If Participant has a standing appointment, he/she agrees to provide any cancellation notice at least 24 hours prior to the next appointment. Cancellation notice shall be sent via email to sghughes@corevaluepilates.com. Participant agrees to pay full payment for any cancelled appointment where Participant failed to provide 24 hour cancellation notice.
Instructor reserves the right to end any lesson at any time, if ending the lesson is in the best interest of the Participant.
Participant agrees not to be under the influence of any alcohol or illicit drugs at the time of each appointment. Participant will inform Core Value Pilates, LLC of any prescription medication taken prior to each appointment and the possible side effects. Thereafter, Core Value Pilates, LLC reserves the right to end the lesson, if ending the lesson is in the best interest of the Participant.
Disclaimers
Participant expressly agrees that use of the Core Value Pilates, LLC’s services, whether in person or on Zoom or any other video conferencing tool, is at the Participant’s sole risk. Core Value Pilates, LLC does not warrant that the services will be uninterrupted, secure or error free; nor does it make any warranty as to the results that may be obtained from the use of the services, or as to the accuracy, reliability, security or content of any information or service contained in or provided through the services.
No oral advice or written information given by Core Value Pilates, LLC shall create a warranty.
Core Value Pilates, LLC is not responsible for any lost or stolen items.
Core Value Pilates, LLC is not a medical or health care provider and cannot offer any medical consultation.
Limitation of Liability
As a participant at Core Values Pilates, LLC: I, as do my heirs, assigns and/or legal representatives hereby agree to waive, relinquish and release any and all claims for liability and causes of action, including those for personal injury, property damage and wrongful death occurring to me, whenever and however they occur.
I acknowledge, understand and assume the risks of the services provided by Core Values Pilates, LLC which I hereby acknowledge and understand involves strenuous physical activity that may result in personal injury, property loss or even death. I agree to exempt, hold harmless, release and waive liability against Core Value Pilates, LLC, Stacy Geant Hughes or anyone else involved in providing the services of Core Value Pilates, LLC for any personal injury, property loss, property damage and/or death, including if caused by negligence, including the negligence of Core Values Pilates, LLC Stacy Geant Hughes or anyone else involved in providing the services of Core Values Pilates, LLC.
Under no circumstances, including negligence, shall Core Value Pilates, LLC, Stacy Geant Hughes or anyone else involved in providing the services, be liable for any direct, indirect, incidental, exemplary, economic, punitive, lost profit, special or consequential damages or for any damages that result from or are related to the use of services; or that result from mistakes, omissions, interruptions, errors, defects, delays in operation, or any failure of performance.
I acknowledge that I have read the above paragraphs and am fully advised of the potential risks of Pilates and understand these waivers and releases are necessary to allow Core Value Pilates, LLC to exist in its present form.
